It was a bad move on Smith's part to swipe the official aside, but Smith didn't initiate the contact, nor did he strike the official. The ref was pushing him back and did so for about five yards.

Correct call.

And I also think that was a good call not to suspend him, were going to need him against the redskins

It was a typo - The title of the article at the link Yezzir posted said he wouldn't be fined and the following was in the article:

I guess they figured that as a rookie he quickly admitted to his mistake and thus they won't pursue it any further.

I was wondering if that would play into it. Players definitely shouldn't touch refs. By the same token, no ref should be aggressive with a player, especially one who is already hot under the collar at an opposing player.
